Who has to comply with the FTC Safeguards Rule?

Far more businesses than most people expect. "Financial institution" under 16 CFR Part 314 reaches auto dealerships, tax preparers, mortgage brokers and lenders, payday lenders, collection agencies, real estate appraisers and investment advisers not registered with the SEC, not only banks.

Are car dealerships covered by GLBA?

Yes. Dealerships that arrange or extend financing are financial institutions under the Safeguards Rule and owe the full information security programme in 16 CFR 314.4, including the security awareness training for personnel required by 314.4(e)(1).

How often is GLBA training required?

The rule does not set a frequency. 16 CFR 314.4(e)(1) requires security awareness training that is updated as necessary to reflect risks identified by the risk assessment. In practice most institutions train annually, and that is what examiners expect to see, but the rule itself states no interval.

Does the under-5,000-consumer exemption remove the training requirement?

No. The exemption at 16 CFR 314.6 relieves smaller institutions of certain obligations, including the written risk assessment, the written incident response plan and the annual report to the board. The security awareness training requirement at 314.4(e)(1) is not among them.

Does PCI DSS compliance cover GLBA?

No. PCI DSS is a payment card industry contract standard about cardholder data. The Safeguards Rule is federal law about customer information generally, and it requires a whole information security programme. Meeting one does not satisfy the other.

Is this course FTC approved?

No, and no approval scheme exists for Safeguards Rule training. This course addresses the security awareness training element at 16 CFR 314.4(e)(1).
